I understand that I must be at least 16 years of age.
I agree that if I am offered employment by Heaven Hill Farm and accept, my employment will be at will and not for any specific duration, that my employment and compensation can be terminated, with or without cause, and with or without notice, at any time, at the option of either Heaven Hill Farm or myself.
I am hereby informed and I understand that nothing contained in this application, or any written materials, and nothing said to me by an employee or agent of Heaven Hill Farm, shall constitute implied or expressed contract of employment.
I am not a current user of illegal drugs and I understand and acknowledge this to be notice to me that, as a condition of my employment and continued employment, I agree to submit to such lawful examinations as may exist to test for my illegal use of drugs or working under the influence of alcohol, drugs, chemicals or other controlled substances, including but not limited to preemployment examinations and examinations required following my involvement in a work-related accident.
The information I have given on this application is complete, true and correct and I understand that falsification, misrepresentation, or omission on this or any other personnel record can result in rejection of my application and my termination if I am employed by the company.
I hereby authorize Heaven Hill Farm to conduct such reference checks, criminal record checks and other consumer report investigation as Heaven Hill Farm deems necessary in connection with my application for employment and at any time during my employment, I understand that information may be obtained through personal interviews and tother sources, and may include information as to m y character, general reputation and credit, personal characteristics and mode of living. I further understand that upon written request made with a reasonable time, additional information as to the nature and scope of the investigative report, if one is madam will be provided to me.
I authorize my former employers and other individuals, schools, companies, corporations, credit bureaus, courts and law enforcement agencies to give Heaven Hill Farm information concerning me, whether or not it is part of their written record, and I consent or release to Heaven Hill Farm of personal information including but not limited to information concerning my work history, credit, education, motor vehicle and criminal record, and I release all parties including the custodians of such records, from and liability whatsoever on account of providing such information to Heaven Hill Farm.
I agree that all parties to whom a photocopy of this sign agreement, authorization and release, is presented, shall be entitles to relay on such photocopy and consider it a valid and enforceable as the original.
ARBITRATION OF EMPLOYEES RIGHTS
Because of, among other things, the delay and expense which result from use of the court systems, if I am offered employment and accept Heaven Hill Farm and I agree, unless otherwise expressly prohibited by applicable law, to submit to binding arbitration any claims that arise between me and Heaven Hill Farm and any of the current or former officers, directors, employees attorneys and agents, concerning compensation, employment ( including but not limited to any claims concerning sexual harassment) or termination of employment. If applicable law expressly prohibits this agreement to submit any such claims for binding, then, in that case, I agree that I will submit any such claim for Alternate Dispute Resolution, including mediation, before any litigation can be brought by me regarding such claim. I also agree, before such arbitration or Alternate Dispute Resolution process, as the case may be, is used (i) first, to present any such claims in full written detail to Heaven Hill Farm, (ii) next, to pursue to completion any Heaven Hill Farm internal review process and (iii) finally, to file and pursue to completion any external administration remedy (such as with the Equal Employment Opportunity Commission). In any arbitration, the prevailing rules of the American Arbitration Association (and, to the extent not inconsistent, the then prevailing rules of the Federal Arbitration Act) shall apply.
Hill Farm has my permission to use my photo or image in its promotional advertising and on their website.
